South Africa has officially greenlit its digital nomad visa program, sparking debate among locals. The government initially invited public feedback in February to shape the regulations, but the final version remains unchanged.

This move has divided opinions. Proponents see it as a boon for the tech sector, attracting skilled foreign talent. Opponents fear rising living costs, increased inequality, and potential tax avoidance. Additionally, concerns remain about the program's effectiveness due to unresolved issues.
One key question is the minimum income requirement. Will it be based on gross or net income? Are freelancers eligible? Furthermore, South Africa's existing laws require adjustments to accommodate the program.
For example, the current tax code offers no exemption for foreigners working remotely for less than six months. Amending the tax code will be necessary for this exemption to be legal. Another hurdle is the proposed income tax number requirement. Under this regulation, foreign companies employing South Africa-based remote workers would need a local tax number and a registered branch within the country – a complex and potentially off-putting step.
Intellectual property rights also raise concerns. Proposed copyright amendments grant universities and institutions the right to reproduce software without compensating producers. This could discourage digital nomads developing proprietary software while residing in South Africa.
With the visa program now official, it's unclear how the government will navigate these unaddressed challenges as applications begin. Only time will tell if the program attracts the desired talent without the downsides feared by its critics.
